Good Faith Marriage Checklist

Use this checklist to determine the types of supporting evidence you can file with your petition to prove this criteria. You do not need to file all of these items with your petition to prove this criteria; one of these should be sufficient, but the more evidence you can file, the stronger your case will be. 

To Demonstrate a Good Faith Marriage:
  • Client affidavit; 
  • Proof that one spouse is listed on the other spouse's insurance policies, leases, income tax forms, bank accounts, or car title;
  • Proof of other major purchases made as a couple; 
  • Photos taken of the wedding; photos taken during the relationship before and after marriage;
  • Correspondence between spouses both before and after marriage, or between friends and family members;
  • Emergency contact lists at place of employment that lists your spouse as a contact;
  • Birth certificates of the couple's children, if any; or 
  • Affidavits of persons who knew you and your abusive spouse as a married couple. 
To Demonstrate that this was a Legal Marriage:
  • Your marriage certificate with the abusive spouse; and
  • Divorce decree(s), annulment decree(s), or death certificates from prior marriages of both you and your abusive spouse or ex-spouse.
